Version 0.1-draft · pilot version, legal review in progress · no final effective date yet

86'd and 86 Operations are brand names for this service. The legal operating entity has not been finalized; it will be named here before this document can be accepted or become binding. DRAFT — PENDING LEGAL REVIEW. This document has not been reviewed by counsel and is not yet a binding agreement. 1. Parties. These terms are between the subscribing restaurant business ("Customer") and 86'd (86 Operations) ("86'd"). 2. Customer data. Customer owns the business data it and its users upload. 86'd processes it only to provide, secure and support the service, as described in the Data Processing Addendum. 3. Accounts. Customer controls who has access, keeps credentials confidential, and is responsible for its users' activity. Owners and users with financial or administrative permissions must use two-step verification. 4. Acceptable use. Customer will follow the Acceptable Use Policy and will not upload full payment card numbers, CVVs or other prohibited payment data. 5. Subscription & billing. Fees, trials and cancellation follow the plan selected at checkout. Payments are processed by Stripe. Cancelling a subscription stops renewal at the end of the current paid period (monthly or annual) and does not delete Customer data; fees already paid are not automatically refunded. Deleting the account is a separate request (see the Data Export & Account Closure guide). 6. Availability. No uptime commitment is made at this time. 7. Termination & data. Customer may export its data and request closure at any time; see the Data Export & Account Closure guide. 8. Governing law. Ohio (to be confirmed by counsel).
